Court Proceedings

Many cases go to court where the other ADR options have been exhausted and the matter needs to be resolved.

Not all matters settle at mediation. If you don’t reach an agreement at mediation we are experienced and routinely handle and manage the court litigation process for our clients.

We are well organised and have a deep understanding of the laws and regulatory processes in court to ensure that your case is given the best chance of success.

Whilst the intention is to obtain a favourable judgement, during your matter being heard at court you may still have time to mediate and negotiate a settlement out of court.

This is often done once the proceedings have commenced and is a good opportunity to reach an agreement before a judgement is made by the judge.

It is important that all the proper preparation and organisation is taken when compiling your case for Court. Court Proceedings are costly on both parties and carry risks. Having a team that is well organised and your case well prepared will negate a great deal of that risk.

Appeals or Enforcement

A judgement may not be the end of the dispute. After court there may be an appeal or the process to enforce the court order. Appeals require further preparation or defence. Enforcement may mean damages are payable or other courses of action having to be taken by the parties.

It is important that your legal advisors can help with these issues after your initial court appearance and we are experienced in handling appeals and subsequent issues flowing from judgements and enforcement.
