Debt Recovery

If you are a creditor or a debtor facing debt recovery action we can assist. Our experienced debt recovery lawyers can help you recover your funds or dispute a claim.

Assistance for Creditors

As a creditor you can become frustrated by trying to recover debts from clients and may need advice on how to get paid faster and help your cash flow. Our debt collection lawyers are also skilled when you may want to continue the commercial relationship with the client who owes you money.

Some clients who choose a debt collection agency will end up frustrated as they have little influence and some experienced debtors will ignore their calls and the outstanding monies. Debt Collectors only have a specific scope and this approach should not be used for all types of debt collection.

We can help creditors in a variety of ways to recover bad debts depending on the amount outstanding and the debtor. In many cases you may be able to recover some of your legal costs.

As a creditor you have six years to pursue a debtor so prior to writing off what you see as a bad debt part of your credit management should be to consider what courses of action you should take. A debt collection lawyer can help you devise a plan and get clients to pay their debts faster.

There are a variety of options available and often good results can come from one simple letter from a lawyer. Most debtors will want to avoid further recovery action and as legal processes can be time dated they know they have to pay or face insolvency.

We can assist from simple debt recovery action through to handling complex commercial litigation and dispute resolution to help get your debtor to pay.

We routinely assist clients with:

  • Letters of Demand
  • Negotiation of Debts (Deed of Settlement) and Payment Plans
  • Magistrates Court
  • VCAT
  • Statutory Demands
  • Supreme Court
  • Enforcing Judgement
  • Sherriff
  • Appointment of Liquidators

Assistance for Debtors

You may have received a summons for an amount due or a letter of demand or a Statutory Demand for an outstanding amount. It is important that you act quickly as many debt collection actions have strict time limits.

If the creditor has commenced legal action you will need legal advice regardless of whether you agree that the amount is outstanding or not.

We have extensive skills in assisting clients in negotiating debts. We can assist in liaising with providing advice and negotiating payment plans.

We are also successful in advising and negotiating with banks, lenders and the ATO. We have helped clients who may be experiencing cash flow issues to enter into payment arrangements and seek to reduce the interest and any penalty charges. It can also help relieve you of the strain of having these discussions with other parties.

If you are experiencing difficulties paying your bills the earlier you seek assistance the better the outcome is usually.

Having a lawyer dealing with the issues usually forces your creditor to regard your position as serious and can mean that they are more negotiable. This can allow you time to restore your position faster and clear the debt.

What should I do when I have received a Statutory Demand for Payment of a Debt?

We are experienced in handling and negotiating statutory demands for debtors and creditors. You can seek to have the statutory demand set aside and as there are strict procedures to follow you should seek legal advice. Quite often the procedures have not been followed to the strict guidelines and can be set aside.

If the application is set aside this will only allow you further time to negotiate the debt. The claim may not be correct or what was agreed upon and we can assist in reducing the amount owing or having the debt cleared.

It is important that you act quickly as you only have a limited time frame to respond. If you do not respond your company is deemed to be insolvent. The creditor will obtain judgement and will be able to appoint a liquidator to your company.

A statutory demand is a test of whether a company is solvent or not.

We work with both debtors and creditors to find the most cost-effective solution to getting paid. Our law firm has extensive experience and we have a very professional and organised approach to law.

We assist many clients in a wide range of commercial matters.

If I had of gone to another law firm that was cheaper I may have saved many thousands of dollars but as it turns out I may have lost a lot more than that upon settlement.
